Agreement The Pakistan Agricultural Research Council, Islamabad, hereinafter referred to as "PARC" a body corporate enacted through Ordinance No. XXXVIII of 1981, on the one part, and “_____________________________” for the Host Institute, hereinafter called Host Institution of the project, on the other part, for the implementation of agreement for “__________________________________________” HAVE AGREED AS FOLLOWS: Article 1: General The project referred to above shall be financed by AREF of ALP, PARC in due regard of its financial and budgetary rules and regulation, including specific regulations notified from time to time. It shall be executed by the Host Institution in accordance with the terms and conditions set out in this Agreement and its two annexes (Project Summary and Budget Breakup) which form an integral part of this Agreement. Article 2: Nature and Scope of the ProjectThe scope and cost of the project for implementation during _________ are given at Annexures I & II respectively. Article 3: Principal Investigator The Principal Investigator of the project will be_________________________________________With mutual agreement between PARC and the host institution, the PI can be changed, if it becomes inevitable due to certain circumstances beyond the control of the signatories. Article 4: Financial obligations of the PARC Article 5: Capital Assets and its Disposal The use of grant funds is authorized for the purchase of capital assets provided/specified in the budget breakup in a transparent way as identified in the project. No additional capital asset items may be purchased from grant funds and the total amount indicated may not be exceeded as budgeted in project document. At the termination of the grant, the PARC reserves the right to appraise all capital assets purchased entirely with grant funds and to determine their disposition. In case this grant is terminated prior to its normal expiration date, the disposition of capital assets purchased in part with grant funds will be determined by PARC as its sole owner. Article 6: Access to Facilities Records and Accounts Accredited representatives of the PARC shall have access at any reasonable time to the laboratories, offices, or other facilities related to the work. Also all data, information, records, reports, and accounts of the host institution relating to the project shall be made available to these representatives. Such data, information, records, reports, and accounts shall be maintained and made available for review by PARC up to maximum of ten years period beyond the termination date of the grant. Officers and employees of the host institution, or other personnel, assigned to or engaged in the conduct of the project shall be available for consultation with such representatives at any reasonable time. Article 7: Audit & Unspent Grant Fund The accounts record of the above project will be maintained in an auditable form and subject to regular audit by the host institution as well as by the PARC. ALP funds for this project will be kept in an approved scheduled bank in the current account and will not be invested. Any unspent balance shall be refunded to the PARC on termination/completion of the project. Article 8: Procurement The institution shall procure the equipment and supplies for the project as provided in the budget breakup in accordance with the prescribed system of the host institution. Article 9: Obligations of Principal Investigation (PI)
Article 10: Remuneration to Principal Investigator (PI) The Principal Investigator shall be entitled to remuneration @ one month basic pay per year subject to his performance being adjudicated as satisfactory by the PARC after the evaluation of annual financial and technical progress reports. Article 11: Reporting Requirement For each year of this grant, two (six monthly) fiscal reports showing the amount of grant funds received and spent and two (six monthly) technical progress reports showing progress of the research are to be submitted by the host institution. Detailed information and instructions concerning the preparation and submission of these reports including reporting dates will be provided to the host institution promptly after the original grant letter is signed and returned from the host Institution. At the termination of the project a final report will be required covering the financial and technical aspects of the research performed during the entire period of the project. In addition, the host institution will furnish such other reports relating to the project as many as required by the PARC. Article 12: Research Results and Benefits Results determined based on the research conducted under the above referred project can not be applied for the patient without prior approval of PARC. Manuscripts prepared by the host institution shall be furnished to the Executive Director ALP in quard-duplicate in English, when the article is submitted for publication. The preparation, content, editing, submission for publication of such manuscripts are the responsibility of the host institution. However, prior to the submission of this manuscripts for publication consent of PARC will be sought. All manuscripts prepared by the host institution and related reprints are required to contain a footnote such as “This research has been financed in part or full by PARC under Agricultural Linkages Program”. Upon publication 25 copies of reprints shall be furnished to the ALP Secretariat, PARC. Article 13: Patent and License Rights Any patent-able results which develop from research under this grant must be made available to the PARC. The host institution may secure patents on the results from this research but with the prior approval of PARC which must be granted a worldwide, nonexclusive, irrevocable, royalty-free license to use the patent, for Pakistan purpose. Article 14: Research Material Upon request the host institution will provide the PARC with seeds, plants, vaccines, or any other such research material discovered or developed during the life of the project. Article 15: Transport/Logistic Facilities The office accommodation, telephone, furniture and items of contingent nature will also be provided by the host institution. Transport will also be provided for the work of the project by the host institution and hire charges as charged from others in the same host institution for the use of vehicle will be paid out of the project funds. Article 16: Travel Grant funds may be used to finance short term travel of PI and concerned staff working in the project for the effective prosecution of the research. Such travel within the country where the research is being performed should be in accordance with the rules and regulations of the host institution. Travel outside the country under exceptional circumstances, is to be authorized in writing by the Chairman, as per rules before travel is undertaken. Article 17: Recruitment in the Project Under ALP any kind of regular appointment absolutely will not be allowed. However, under specified and under exceptional circumstances, restricted contract appointments will be made on year to year basis during the life of the project without any financial liability on the part of PARC/ALP after termination of project. The contract appointments will be approved by the Chairman, on the recommendations of Selection Committee of the host institution in which PARC will be represented. Article 18: Monitoring and Evaluation The PARC, will arrange monitoring and evaluation of the progress of the research/ study undertaken under the project through its own scientists or experts to be specially commissioned for the purpose. In the event of such an evaluation the host institution shall extend all possible assistance for the purpose. Article 19: Amendment
Article 20: Arbitration In case of any dispute what so ever nature, the matter shall be referred to Chairman, PARC as sole arbitrator under Arbitration Act 1940. The decision of Chairman, PARC, will be final and binding on both parties and it cannot be challenged in any court of law. In witness of the above, parties have affixed their signatures hereunder.
